Decision of the Constitutional Court (Mahkamah Konstitusi MK) No. 128/PUU-XXIII/2025 has now extended the dual-office ban to Vice-Ministers, thereby prohibiting them from simultaneously occupying certain roles, including commissioners for State-Owned Enterprises (Badan Usaha Milik Negara/BUMN). The MK has also stressed the importance of ensuring that all Vice-Ministers remain focused on their ministerial duties and avoid any conflicts of interest. The government has been granted a two-year transition period in which to adopt this new Decision and gradually appoint qualified professionals as replacements.
Although the core procedures that address the handling of judicial review petition cases through the Constitutional Court (Mahkamah Konstitusi MK) have been retained, the new framework of Regulation 7/2025 now clarifies that the MK will officially render verdicts on formal judicial review cases within 60 business days of receiving relevant statements from the Indonesian President and/or Indonesias House of Representatives (Dewan Perwakilan Rakyat/DPR) during legal proceedings. Furthermore, Regulation 7/2025 has also narrowed the definition of other parties that have an interest in filed judicial review petitions (Related Parties) so that it now only encompasses parties that have a direct interest in the subject matter of a given petition case.
the policy of expenditure efficiency is now extended beyond the year 2025 through the issuance of Regulation of the Minister of Finance No. 56 of 2025 on the Procedure for the Implementation of Expenditure Efficiency within the State Revenue and Expenditure Budget, which sets out the ground rules on the implementation of expenditure efficiency within the state budget. The result of the efficiency itself shall be utilized for the Presidents priority programs.
Decision of the Constitutional Court (Mahkamah Konstitusi/MK) No. 21/PUU-XXIII/2025 affirms that Vice-Ministers, as state officials, are also subject to the prohibition on the occupying of dual offices, as originally set out under Law No. 39 of 2008 on State Ministries, even though a recent petition has been ruled inadmissible. Despite this, several Vice-Ministers are still serving as commissioners in State-Owned Enterprises (Badan Usaha Milik Negara/BUMN), reflecting the current governments ongoing non-compliance with constitutional principles on conflict of interest.
This Regulation outlines a comprehensive set of measures aimed at the prevention of Crimes of Sexual Violence (Tindak Pidana Kekerasan Seksual "TPKS") across various sectors. It also guarantees the right of victims to mitigation, protection and recovery, which must be provided promptly and tailored to the needs of individuals while ensuring their privacy and dignity, as well as preventing their revictimization. Additionally, the new Regulation stipulates that victims, their families and guardians may request the removal or termination of TPKS-related digital content.
The recent handing down of Constitutional Court (Mahkamah Konstitusi "MK") Decision No. 3/PUU-XXII/2024 ("Decision 3/2024") challenges the prevailing interpretation of free compulsory basic education, as defined under Article 34 (2) of Law No. 20 of 2003 on the National Education System ("Law 20/2003"), by expanding the obligation of the state beyond public schools to include private schools. While recognizing government efforts to support private education amid budgeting constraints, the MK has now permitted private schools to charge tuition fees, particularly institutions that offer specialized programs, provided that any such schools offer financial assistance if public schools are unavailable.
Regulation 24/2025 represents a breakthrough for Witness-Perpetrators by granting them special protections and the possibility of rewards (e.g. sentence reductions or early releases). In this regard, all such requests will be subject to a strict two-stage review process and must meet various substantive and administrative requirements. Protections such as separate detention and testimony safeguards can also be granted proactively if safety is considered to be at risk. These rewards are based on the quality and consistency of testimony, as well as on the cooperation of witnesses with the authorities.
The organization of research and innovation data ("Data") under the National Research and Innovation Agency (Badan Riset dan Inovasi Nasional "BRIN") will now be subject to various measures and mandates that specifically relate to the governance of research and innovation data ("Data Governance"). In terms of said Data Governance, this framework also mandates that all collected Data will be stored at a secure location with adequate safeguard measures being put in place, which include mandated information security and personal data protection-related measures.
Indonesias Constitutional Court (Mahkamah Konstitusi "MK") recently completed a judicial review of Law No. 1 of 2024 on the Second Amendment to Law No. 11 of 2008 on Electronic Information and Transactions ("Law 1/2024"), with a particular focus on defamation, as disseminated via electronic media, and the incitement of hate crimes. The petitioners had challenged Articles 27A and 45 (4) of Law 1/2024 for the vagueness of their language, particularly the term other people, which seemed to lack any clear boundaries. In its ruling, the MK declared these provisions to be conditionally unconstitutional unless they are interpreted to exclude government bodies and specific groups.
The Indonesian National Police Force (Kepolisian Republik Indonesia/Polri) is now authorized to engage in the functional supervision of foreign citizens within Indonesian territory ("Foreign Citizen Supervision") in order to prevent and mitigate various potential national security threats (e.g. espionage, radicalism and other potential security threats against Indonesian and foreign citizens). The new Foreign Citizen Supervision regime will be implemented as follows: 1) Administrative supervision (i.e. requesting of information on foreign citizens and the issuance of certificates); and 2) Operational supervision.
