The updated framework outlines a number of new prerequisites and requirements for WIUP/WIUPK expansion, requiring applicants for WIUP/WIUPK expansion to fulfill certain criteria prior to completing a submission. The prerequisites include an updated more comprehensive set of requirements for areas that qualify for the submission of applications for expansions.

Funding and financing support for an accelerated energy transition within the electrical power sectorshould be provided by the government for the early termination of the operations of PLTU, early terminations of the contract periods of sale-and-purchase agreements for PLTU and/or the development of renewable energy plants.

Regulation 45/2023 contains a number of new mandates and aspects related to Radiation Safety management, which now includes aspects of the responsibilities of business entities that obtain nuclear-related permits, human resources and management systems.

Contractors that take the form of Indonesian legal entities are now required to report their income tax, including their oil-and-gas income tax (Pajak Penghasilan Minyak dan Gas "PPh Migas"), as a part of their annual income tax returns (Surat Pemberitahuan Pajak "SPT"). In this regard, PPh Migas amounts will be calculated based upon either of the following reports: 1) Final Quarterly Reports ("FQR") for quarter IV; 2) Final FQR for the last financial year (tahun buku); or 3) FQR final settlement rights and obligations.

Decree 297/2023 describes a total of four mechanisms for the processing of IUP for metal minerals and coal that may be utilized by business entities under certain conditions.

Regulation 10/2023 has now adjusted the applicability period for said RKAB, which was previously set at one year, to the following periods: 1) For the exploration phase: one year; and 2) For the production - operation phase: three year period or in accordance with the relevant IUP or IUPKs (collectively referred to as "Mining Permits") remaining validity periods (for Mining Permits that are valid for less than three years). Furthermore, Regulation 10/2023 has also introduced a specific timeframe for the submission of RKAB for the production - operation phase.

Exchange Users must comply with various obligations, otherwise, they may be subject to the imposition of sanctions by the Organizer. These obligations include: 1) Must maintain the confidentiality of their given user-id and password and are prohibited from transferring them to any other parties; 2) Must comply with provisions, requirements and procedures that relate to the use of any facilities that are provided by the Organizer; 3) Must submit incidental reports within a maximum of seven Organizer days of any changes being made to certain types of information (e.g. business licensing, names of Exchange Users, information relating to Exchange Users, company deeds, etc.)

it should be highlighted that WIUP and WIUPK under the new procedure may only be secured by business actors who do not already possess any of the following types of mining business licenses: Mining Business Licenses (Izin Usaha Pertambangan "IUP"), Special IUP (IUP Khusus "IUPK"), IUPK as a continuation of operation contracts/agreements, Community Mining Licenses (Izin Pertambangan Rakyat/IPR), Rock Mining Licenses (Surat Izin Penambangan Batuan/SIPB), Mining Service Business Licenses (Izin Usaha Jasa Pertambangan/IUJP), Transportation and Sales Licenses, Contracts of Work (Kontrak Karya/KK) or Coal Contracts of Work (Perjanjian Karya Pengusahaan Pertambangan Batubara/PKP2B).

Amongst various applicable competencies, the competencies that generally relate to K3 management include: 1) Application of relevant K3 laws and regulations; 2) Application of K3-related communications; 3) Analysis of K3-related risks; 4) Formulation of K3-related working programs; 5) Application of K3-related inspections; 6) Management of K3-related audits; and 7) Application of K3-related culture

Management should also be implemented in line with the following conditions: 1) Energy providers that utilize energy/energy sources 6,000 equivalent tons of oil per year; 2) Users of energy/energy sources that utilize energy/energy sources 4,000 equivalent tons of oil per year (for the transportation and industrial sectors) and 500 equivalent tons of oil per year (for the building sector)
