While Indonesian producers are obligated to reduce waste, existing regulations do not explicitly address sustainable packaging, thereby creating a regulatory gap. Comparative practices illustrate possible approaches: the European Union imposes material standards, Germany requires producer registration and compliance with collection systems, and Singapore mandates packaging reporting. Strengthening applicable framework and adopting comparable measures could close this gap and align Indonesia with international sustainability standards.
As the utilization of underground space is considered more important than ever, the legality of said usage tends to be more complex than it seems. While Law 5/1960 with its vertical attachment principle links underground use to surface land rights, Law 6/2023 and its implementing framework classify underground space as either shallow or deep, treating it as legally distinct. Moreover, regional regulatory approaches, such as that set out under Regulation 167/2012 in Jakarta, govern permitted activities based on this classification.
Given the frequent problems that are encountered during attempts to enforce Arbitral Awards (and which often drag on to the point of litigation through the courts), This ILD reports on trends in MA Decisions on the annulment of Awards in Indonesia. The issue of music royalties within Indonesia has recently attracted intense public debate and scrutiny. This has all been sparked by a copyright infringement case that involved a Balinese restaurant chain. Although the case was ultimately settled amicably, questions were subsequently raised regarding the ways in which royalties are calculated, the persons who have the authority to collect them and whether the current royalty payments system is being implemented transparently
The most recent version of the July 2025 Draft Bill on New and Renewable Energy (Energi Baru dan Terbarukan - EBET) has now been made available to the general public. The Case of Tom Lembong, the Former Minister of Trade, drew controversy not only due to the financial impact but also because the court treated Tom Lembongs preference for a capitalist economic approach as an aggravating factor. Regulation of the Government No. 28 of 2025 updates Indonesias Risk-Based Business Licensing (Perizinan Berusaha Berbasis Risiko PBBR) system with stricter Service Level Agreements (SLA) and the new positive-fiction mechanism. SLAs impose clear deadlines for key approvals like Conformity of Space Utilization Activities and Environmental Approvals, aiming for faster, more accountable processes. The positive-fiction rule enables automatic approval via the Online Single Submission (OSS) system if no official response is given within the set SLA timeframe, reducing red tape and improving licensing efficiency across sectors.
This second part of the Indonesian Legal Digest analyzes eight sector-specific import frameworks. Aimed at streamlining import procedures, the regulation removes or relaxes prior licensing requirements for various commodities, such as forestry products, fertilizers, fuels, plastic raw materials, certain chemicals, saccharin and alcohol-based fragrances, pearls, food trays, footwear, and bicycles.
To enhance ease of doing business, Indonesia issued new regulatory framework on import policy and provisions. This new regulation streamlines import licensing, supports investment in labor-intensive sectors, and addresses United States criticism of Indonesias complex import regime. The regulation is part of a broader deregulation package, including eight sector-specific rules that restructure import requirements for various commodities, aiming to improve clarity, reduce bureaucracy, and boost national economic stability.
The government recently issued a new framework that provides a detailed structure for environmental planning at national, provincial, and municipal levels through the Environmental Protection and Management Plan (Rencana Perlindungan dan Pengelolaan Lingkungan Hidup - "RPPLH"). This framework mandates the preparation of RPPLH, which includes environmental inventory, ecoregion designation, and assessments of supporting and carrying capacities. Once implemented, RPPLH is expected to enhance environmental sustainability and address challenges like climate change.
