Draft Regulation on the Use of Aboveground and Underground Spaces: An Overview of Permitted Activities and Rights

As mandated under Law No. 6 of 2023 on the Enactment of Regulation of the Government in Lieu of Law No. 2 of 2022 on Job Creation into Law (“Law 6/2023”), the government is currently preparing a Draft Regulation of the President (“Draft Regulation”) on the Usage and Utilization of Land in Aboveground and Underground Spaces (collectively referred to as “Spaces”).[1] Upon its promulgation, the Draft Regulation will serve as a key reference for the management of land use in these Spaces, ensuring compliance with national spatial planning and land use policies.
