Overview

On 2 January 2026, Law No. 1 of 2023 on the Criminal Code (Kitab Undang-Undang Hukum Pidana – “KUHP”)[1] and Law No. 20 of 2025 on Criminal Procedural Law (Kitab Undang-Undang Hukum Acara Pidana – “KUHAP”)[2] officially came into force. Prior to this epochal day for Indonesian law, the House of Representatives (Dewan Perwakilan Rakyat – “DPR”) had passed the revised KUHP on 6 December 2022 before the new framework’s subsequent promulgation on 2 January 2023. Meanwhile, the revised KUHAP was approved by the DPR on 18 November 2025 and officially promulgated on 17 December 2025 before coming into effect in 2026.[3]
