Attention Employers and Workers: New P2K3 Framework Requires Semi-Annual Reporting and Mandates Equal Representation in High-Risk Companies

Back in 1970, the Indonesian Government issued Law No. 1 of 1970 on Workplace Safety (“Law 1/1970”), which mandated the establishment and organization of Occupational Health and Safety Supervisory Committees (Panitia Pembina Keselamatan dan Kesehatan Kerja – “P2K3”). In order to implement this Law, the Minister of Manpower (“Minister”) previously issued Regulation No. PER-04/MEN/1987 on P2K3 and Procedures for the Appointment of Workplace Safety Experts (“Regulation 4/1987”). Under Regulation 4/1987, any workplace that meets certain conditions (e.g. has at least 100 employees) must establish a P2K3, which will ultimately be the responsibility of the relevant employer or management (collectively referred to as “Employers”).[1]
