Draft Bill on Criminal Adjustment: Short-Term Imprisonment under Non-KUHP Laws to be Replaced with Fines

In 2023, Indonesia’s House of Representatives (Dewan Perwakilan Rakyat – “DPR”), in conjunction with the Indonesian President, officially issued Law No. 1 of 2023, which comprises Indonesia’s most recent Criminal Law Code (Kitab Undang-Undang Hukum Pidana -“KUHP”). The new KUHP is set to replace its century-old predecessor,[1] while KUHP will officially come into force in 2026.[2] Meanwhile, all of the necessary Implementing Regulations to this framework are required to be issued by the end of 2025.[3]
