Overview
The inclusion of the Draft Bill on Criminal Procedural Law (“Draft Bill”) as a part of the 2025 Priority National Legislative Program (Program Legislasi Nasional/Prolegnas) marks a critical opportunity to initiate long-overdue criminal justice reform within Indonesia. According to the Chair of Commission III of Indonesia’s House of Representatives (Dewan Perwakilan Rakyat – “DPR”), discussions on a revised version of the Draft Bill are set to commence from scratch, while the Draft Bill will be proposed as a legislative initiative by the DPR.[1] If the Draft Bill is ultimately enforced, then this forthcoming framework will repeal and replace the existing framework of Law No. 8 of 1981, which bears the same title as the Draft Bill (“Law 8/1981”).[2]
