Farmers Required to Secure Mandatory ISPO Certification by November 2025

In line with the development of sustainable plantations and in order to take account of economic, socio-cultural and ecological aspects, as mandated under Law No. 39 of 2014 on Plantations, as amended by Regulation of the Government in Lieu of Law No. 6 of 2023 (“Law 39/2014”), the president previously issued Regulation of the President No. 44 of 2020 on the Indonesian Sustainable Palm-Oil (“ISPO”) Certification System (“Regulation 44/2020”) which, in essence, addresses a wide range of matters that specifically relate to ISPO certification, including its implementation, granting and available administrative sanctions (see: “Mandatory ISPO Certification for Palm-Oil Businesses”). In order to build upon the above-mentioned regulatory frameworks, the Minister of Agriculture (“Minister”) subsequently introduced Regulation of the Minister No. 38 of 2020 on the Implementation of the Indonesian Sustainable Palm-Oil Certification System (“Regulation 38/2020”) in the same year, which is used as a technical reference in relation to the implementation of the ISPO certification system and which sets out various criteria, procedures and certification costs associated with ISPO certification.[1]
