Pour Point Testing Parameters for Bio-Hydrocarbon Diesel May Now Exceed 21C upon Fulfilling Three Criteria

In 2022, the Director-General of New, Renewable Energy and Energy Conservation at the Ministry of Energy and Mineral Resources ("Director-General") issued Decree No. 95.K/EK.05/DJE/2022 ("Decree 95/2022"), which in essence set out the applicable standards and specifications that apply to bio-diesel fuels, which are categorized as other types of domestically marketed fuels ("Bio-Hydrocarbon Diesel"). Decree 95/2022 was summarized in the following edition of Daily Updates: “Director-General of EBTKE Stipulates Quality Standards for Bio-Hydrocarbon Diesel as Other Fuels Marketed Domestically”.
However, in order to revise the applicable standards and specifications for Bio-Hydrocarbon Diesel, as well as to adjust the applicable pour point testing parameters ("Pour Point Parameters"), the Director-General has now decided to issue Decree No. 112.K/EK.05/DJE/2024 on the Amendment to Decree 95/2022 ("Amendment"), which has been in force since 1 July 2024.
As outlined comprehensively under the Appendix to the Amendment, the applicable Pour Point Parameters now refer to parameters that are set out under this latter framework. In this regard, the currently applicable maximum limits for said Pour Point Parameters comprise two values: 1) Maximum of 21°C: only applicable if certain criteria are met (i.e. for diesel fuel mixtures that are utilized directly, provided that the relevant temperatures are above the Pour Point Parameters threshold and provided that the relevant fuel is received by Bio-Hydrocarbon Diesel consumers); and 2) Maximum of 18°C: to be fully applicable by 1 July 2027.
Consequent to the enforcement of the Amendment, the Pour Point Parameters originally outlined under the framework of Decree 95/2022 have now been repealed and replaced.
