Prevention and Mitigation of Unlawful Aviation Interference: Mandatory Aviation Security Threat Assessments Introduced

  • The Director-General of Air Transportation at the Ministry of Transportation ("Director-General") has introduced a set of technical guidelines for use during assessments of aviation security threats ("Guidelines") through the issuance of Decree No. PR 22 DJPU of 2024 ("Decree 22/2024"), which has been in force since 20 June 2024.
  • As detailed comprehensively under the Appendices to Decree 22/2024, the Guidelines will now serve as a reference for use by various flight operators during the implementation of mandatory aviation security threat assessments ("Threat Assessments"). The aforementioned flight operators comprise eight entities that include: 1) Airport organizer units; 2) Airport business entities; 3) Domestic and foreign airline companies; 4) Known consignors; and 5) Regulated agents.
  • In essence, the above Threat Assessments should be undertaken in order to prevent and mitigate any acts of unlawful interference that occur within the aviation sector (e.g. aircraft hijackings, hostage taking and the smuggling of illegal contraband or weapons). Intelligence and/or other information relating to unlawful interference ("Threat Intelligence") should be constantly gathered, analyzed and sent to relevant parties by the Director-General and flight operators.
  • Any received Threat Intelligence will be subject to Threat Assessments. Said assessments comprise airport-level and national-level Threat Assessments. Broadly speaking, Threat Assessments should be drafted through the utilization of admiralty codes (i.e. validity and reliability of Threat Intelligence), while the results of said assessments may indicate any of three conditions regarding the probability of said threats materializing.
