Draft Bill on the Second Amendment to Patent Law Now Included in 2024 Prolegnas

During a recent working meeting that was held between the government, as represented by the Ministry of Law and Human Rights, and the House of Representatives (Dewan Perwakilan Rakyat – "DPR"), it was affirmed that both of the institutions in question had come to an agreement and had decided to approve further deliberations of the Draft Bill ("Draft Bill") on the Second Amendment to Law No. 13 of 2016 on Patents ("Law 13/2016"). As a legislative initiative of the government, the Draft Bill itself has therefore now been included as a part of the 2024 National Legislation Program (Program Legislasi Nasional/Prolegnas).
In response to this approval, the Minister of Law and Human Rights, Yasonna H. Laoly ("Minister"), has stated that the Draft Bill is ultimately aiming to provide further protection and improved services that are in line with current requirements and developments in international law within the intellectual property sector.
The Draft Bill is set to cover a wide range of issues relating to patents, including innovations and discoveries, while the Minister has affirmed that the Draft Bill comprises 22 provisions that encompass the following aspects: 1) Definition and threshold for inventions; 2) Period for the publication of patents; 3) Exemptions from criminal charges; and 4) Objects of civil lawsuits. In addition, the Draft Bill also outlines a number of provisions on innovations, which include a mechanism for the accommodation of inventions that are a development of products/processes that derive from genetic resources.
The Minister has also stated that the government recently participated in a meeting on biodiversity with member states of the World Intellectual Property Organization (WIPO). During this meeting, the Minister affirmed that Indonesia is among 62 countries that are currently working on a dedicated framework that addresses the area of genetic resources.
