Guidelines for the Evaluation and Approval of RKAB for Mineral and Coal Mining Activities Updated

In 2023, the Minister of Energy and Mineral Resources ("Minister") issued Decree No. 373.K/MB.01/MEM.B/2023 ("Decree 373/2023"), which contains a set of guidelines that specifically address the drafting, evaluation and approval of working plans and budget allocations (Rencana Kerja Dan Anggaran Biaya – "RKAB") for coal and mineral mining activities. Decree 373/2023 was summarized in the following edition of Daily Updates: “Govt. Issues Guidelines on Drafting, Evaluation and Approval of RKAB for Mineral and Coal Mining Activities”.
However, in an effort to further improve the applicable guidelines for RKAB evaluations, the Minister has decided to readjust various essential evaluation criteria and fundamental criteria (e.g. relating to the fulfillment of various technical and Non-Tax State Revenue [Penerimaan Negara Bukan Pajak/PNBP] aspects), as originally featured under Decree 373/2023, through the issuance of Decree No. 84.K/MB.01/MEM.B/2024 as the Amendment to Decree 373/2023 ("Amendment"), which has been in force since 5 April 2024.
As the introduction to the Amendment aims to ultimately provide more measurable and accountable evaluation parameters that are in accordance with the relevant laws and regulations, as well as with good technical mining principles, the Amendment has now affirmed that the various provisions that were originally outlined under Appendices III – VID to Decree 373/2023 will be brought into line with Appendices I – IVD to the Amendment. Amongst other areas, these Appendices broadly cover the procedures for securing RKAB approvals for the following activities: 1) Mining Business Licenses (Izin Usaha Pertambangan – "IUP") or special IUP (IUP Khusus – "IUPK") for mining exploration; and 2) IUP or IUPK for production operations.
