Govt. Issues Guidelines on Drafting, Evaluation and Approval of RKAB for Mineral and Coal Mining Activities

The Minister of Energy and Mineral Resources ("Minister") has issued Decree No. 373.K/MB.01/MEM.B/2023 ("Decree 373/2023"), which contains a set of guidelines that specifically address the drafting, evaluation and approval of working plans and budget allocations (rencana kerja dan anggaran biaya – "RKAB") for coal and mineral mining activities. Decree 373/2023 has been in force since 20 October 2023.
Generally speaking, the scope of the guidelines that are set out under Decree 373/2023 break down as follows: 1) Format for the drafting of RKAB; 2) Procedures for the submission, evaluation and approval of RKAB; and 3) Format for RKAB approvals. It should also be noted that the various formats and procedures provided under Decree 373/2023 have been categorized based on Mining Business License (Izin Usaha Pertambangan – “IUP”) and Special IUP types, as secured by relevant business actors.
It is also important to note that RKAB must fulfill various essential evaluation criteria, as summarized in the table below:
