Development of the Draft Bill on the Second Amendment to the Patent Law

  • The Draft Bill on the Second Amendment to Law No. 13 of 2016 ("Draft Bill") on Patents has finally been listed as a part of the National Legislative Program for 2024 after a lengthy process of academic manuscript preparation, which has been underway since 2018. One of the factors that has been driving the progress of the Draft Bill is the relationship between patents and the development of the economy and trade.
  • The Director-General of Intellectual Property, Min Usihen, has stated that there are several weaknesses in the current framework of Law No. 13 of 2016 on Patents, including: 1) The narrow scope of the definition of inventions; 2) The unclear scope of inventions related to computer programs; 3) The implementation of patents by the government, which has to date been limited to domestic requirements only; and 4) The shortness of the grace period policy.
  • In response to the abovementioned weaknesses, the Draft Bill features provisions that specifically address the following areas: 1) The amendment of various aspects that specifically relate to policy developments within the area of service innovations and harmonization with international provisions; 2) The amendment of the administrative processes involved in patent applications, including administrative requirements, charging fees and time limits; 3) The amendment of the patent publication time limits; 4) Exceptions to criminal charges and civil lawsuit objects; and so forth.
