Draft Bill on Broadcasting Law Amendment: Various Issues Highlighted

  • Indonesia’s House of Representatives (Dewan Perwakilan Rakyat Republik Indonesia "DPR RI") is currently preparing a Draft Bill that will eventually revise Law No. 32 of 2002 on Broadcasting (referred to as "Draft Broadcasting Bill"). This new Draft Broadcasting Bill has the potential to restrict the rights of the general public as regards access to broadcasting content.
  • According to the Executive Director of Remotivi, Yovantra Arief, the latest version of the Draft Broadcasting Bill that was obtained on 2 October 2023 extends the overall scope of broadcasting from conventional media (e.g. TV and radio) to digital broadcasting. As such, over-the-top (OTT) digital platforms such as Netflix, Amazon Prime, Vidio and other such media companies will be required to comply with the various provisions set out under the forthcoming revision to Indonesia’s Broadcasting Law. In this regard, Arief argues that the introduction of such a broad regulatory framework could ultimately stifle press freedom and creativity, as expressed through digital media. 
  • Arief has also further stated that Article 56, Paragraph (2) of the Draft Broadcasting Bill features a list of various types of prohibited broadcasting content, both conventional and digital. These prohibitions encompass shows that include content relating to drugs, gambling, violence, cigarettes, alcohol, violence and mysticism. These potential prohibitions are believed to be problematic and open to multiple interpretations, making them vulnerable to being used in order to oppress certain parties or opinions.
  • Meanwhile, Bayu Wardhana, an Executive Board Member at Indonesia’s Alliance of Independent Journalists (Aliansi Jurnalis Independen AJI”), has highlighted the consequences that may result from the expansion of the Draft Broadcasting Bill, specifically the obligation of broadcast journalism products to comply with KPI regulations. This will ultimately result in an overlap in authorities since journalism-related products are already regulated and supervised by Indonesia’s Press Council, as mandated by Law No. 40 of 1999 on the Press. Wardhana has also emphasized the rushed and non-transparent nature of the deliberation process for the new Draft Broadcasting Bill and is urging broader stakeholder involvement in order to address various problematic articles and protect creativity across digital media.
