Menkominfo to Issue Regulation on the Organization of PSE Within the Public Sector

The Minister of Communication and Information Technology ("Minister") is currently preparing the Draft Regulation on Electronic System Providers Within the Public Sector ("Draft Regulation") which, when it comes into force, will become the basis for the registration of electronic system providers operating within the Public Sector ("Public Providers"), as well as for data classifications and domain name registrations for Public Providers.
The types of Public Providers that will be bound by the Draft Regulation encompass various institutions and agencies, with the exception of the Financial Services Authority (Otoritas Jasa Keuangan/OJK). The scope of the provisions covered under the Draft Regulation encompasses the following areas: 1) Registration of Public Providers operating within the public sector; 2) Organization of domain names for agencies (instansi); 3) Data classification of Public Providers operating within the public sector; and 4) Cloud computing services.
It should be noted that the Draft Regulation also includes a set of provisions that specifically address the imposition of administrative sanctions, along with various normalization measures. Administrative sanctions may be imposed in the form of written reprimands with set timeframes and temporary suspensions of Public Providers’ activities up to the revocation of Providers’ proofs of registration (tanda daftar).
