New Telecommunications Device Classifications Introduced

In 2019, the Minister of Communication and Information Technology (“Minister”) issued Regulation  No. 1 of 2019 on the Utilization of the Radiofrequency Spectrum Based on Class Licenses (“Regulation 1/2019”), which consolidated the applicable provisions on telecommunications tools and/or devices that utilize the radiofrequency spectrum (collectively referred to as “Devices”).[1] However, as Device technologies have continued to advance, an additional radiofrequency spectrum (“Spectrum”) allocation for Devices that are utilized on a class basis has now been made available. In this regard, the Minister has decided to adjust various provisions that were originally set out under the framework of Regulation 1/2019 through the issuance of Regulation No. 2 of 2023, which bears the same title as Regulation 1/2019 (“Regulation 2/2023”) and which has been in force since 12 April 2023.[2] The issuance of Regulation 2/2023 also repeals and replaces Regulation of the Minister No. 16 of 2016 on Technical Requirements for Near Field Communications Devices (“Regulation 16/2016”).[3]
