BEI Revokes Relaxation of Daily and Monthly Reporting Deadlines: Members of the Stock Exchange to Resume Original Deadlines

Previously, the Financial Services Authority (Otoritas Jasa Keuangan – "OJK") issued Regulation No. 4/POJK.04/2022, which extended the applicability of various policies until a cut-off date of 31 March 2023 in order to maintain the performance and stability of the capital market during the still ongoing Corona Virus Disease 2019 ("COVID-19") pandemic.
However, through the issuance of Letter of the OJK No. S-68/D.04/2023, stock exchange ("Exchange") regulations will now resume the original provisions that were in place prior to the COVID-19 pandemic with various forms of relaxation under certain conditions no longer being available.
In terms of the above matters, the Board of Directors of PT Bursa Efek Indonesia ("BEI") has issued Decree No. KEP-00043/BEI/03-2023 ("Decree 43/2023"), which is set to come into force on 3 April 2023 and which will ultimately revoke Decree of the Board of Directors of BEI No. Kep-00039/BEI/05-2020 ("Decree 39/2020") which previously introduced the relaxation of the daily and monthly reporting deadlines that had to be observed by Exchange members ("Members").
Pursuant to Decree 43/2023, the following forms of reporting are now set to resume their original reporting deadlines, as featured under Rule No. III-D as the Appendix to Decree of the BEI Board of Directors No. KEP-00068/BEI/09-2019: 1) Daily transaction activity reports; 2) Reports on the daily portfolio positions of customers and Members; and 3) Monthly reports that are submitted by Members (e.g. reports that address business activities, customer numbers, transactions that are completed through remote trading devices, and so forth).
In addition, Decree 43/2023 will also reinstate the original deadline for monthly reporting on determinations of haircuts and the submission of guarantee securities reports, as addressed under Rule No. III-1 as the Appendix to Decree of the BEI Board of Directors No. KEP-00022/BEI/02-2017.
