Government to Ban Sale of Cigarettes by Amending Regulation on the Control of Addictive Substances in the Form of Tobacco Products

  • Through the issuance of Decree of the President No. 25 of 2022 on the Government Regulation Formulation Program for 2023 ("Decree 25/2022"), the government is preparing to draft an amendment to Regulation of the Government No. 109 of 2012 on the Control of Addictive Substances in the Form of Tobacco Products ("Regulation 109/2012"). This forthcoming amendment will encompass a ban on the sale of cigarettes which, according to President Joko Widodo, will be aimed at the protection of public health.
  • In addition to the ban on cigarette sales, the planned amendment to Regulation 109/2012 will also address the following matters: 1) Increase the total area of health warning images and texts on tobacco product packaging as a  percentage; 2) Provisions on electronic cigarettes; 3) Prohibition on the advertising, promotion and/or sponsorship of tobacco products through information technology media; 4) Supervision of the advertising, promotion and/or sponsorship of tobacco products through broadcast media, indoor and outdoor media, and information technology media; 5) Enforcement and prosecution; and 6) Information technology media and the implementation of smoke-free areas.
  • Previously, the government has been consistent in its efforts to control the dangers of smoking through the introduction of various excise-related policies, which are being implemented in an attempt to control the consumption of cigarettes and tackle the prevalence of smoking among children aged 10 – 18 across the country. These efforts are also in line with government policies on improving education and outreach to the general public regarding the dangers of smoking.
