Business Licensing Adjustments and Determinations of the Utilization of Special Terminals and Terminals That Are Operated in Parties' Self-Interest

In an attempt to improve the overall capabilities of and services offered by Indonesia’s national seaports, the Director-General of Sea Transportation (“Director-General”) has issued Decree No. A.402/AL.308/DJPL of 2022 (“Decree 402/2022”), which addresses the adjustment of Business Licenses to Support Business Activity (Perizinan Berusaha untuk Menunjang Kegiatan Usaha/PB-UMKU) for special terminals or terminals operated in a party’s self-interest (“Terminal Licenses”) and/or determinations of special terminals or terminals that are operated in a party’s self-interest in order to temporarily serve the public interest (“Terminal Determinations”).[1]
