OJK Finally Introduces Regulatory Framework for Disgorgement and the Disgorgement Fund Within the Capital-Market Sector

The Financial Services Authority (Otoritas Jasa Keuangan – “OJK”) has finally issued the long-awaited[1] Regulation No. 65/POJK.04/2020 on the Return of Unlawful Profits and the Compensation Fund for Investor Losses Within the Capital-Market Sector (“Regulation 65/2020”). This new regulation will serve as a set of guidelines for the implementation of remedial actions and the management of funds aimed at compensating losses that are sustained by investors as a result of illegal activities within the capital-market sector.[2]
