Government Finally Addresses Agrarian Reform

In order to realize equality of possession, ownership, use and the utilization of land, the government recently issued Regulation of the President No. 86 of 2018 on Agrarian Reform (“Regulation 86/2018”).[1]

In essence, Regulation 86/2018 set out the details relating procedures and mechanisms for agrarian reform and specifically addresses the following matters:

Subjects of agrarian reform;
Procedures for agrarian reform;
Settlement of agrarian disputes and conflicts;
Agrarian reform institutions;
Obligations and prohibitions for receivers of plots of land which are subject to processes of agrarian reform (Tanah Objek Reforma Agraria – “TORA”); and
Reporting obligation and funding.
