Licensing and Non-licensing Procedures for Strategic National Construction Projects

Presidential Regulation No. 3 of 2016on the Acceleration of the Implementation of Strategic National Projects (“2016 Regulation”) has been issued, to set out a number of simplified procedures relating to the implementation of any strategic construction projects considered important for the improvement of the people’s welfare.[1]

To this end,the 2016Regulation sets out provisions that cover the following areas:

a.	Licensing and Non-licensing procedures;
b.	Spatial Planning;
c.	Land-procurement processing;
d.	Mandatory domestic components;
e.	Government guarantees;
f.	Assignments for State-Owned Enterprises (BUMN);
g.	Procurement of goods/services; and
h.	Dispute Resolution.
