The Minister of Law and Human Rights (“Minister”) has issued Regulation No. 26 of 2013 (“2013 Regulation”) as the Fifth Amendment to Minister Regulation No. M.HH-01.GR.01.06 of 2010 on Visa on Arrival.
Visa on Arrival (Visa Kunjungan Saat Kedatangan) is a class of visa that can be granted to certain foreign nationals on arrival in Indonesia for a temporary stay of up to 30 days. A Visa on Arrival may be granted for visits to Indonesia for governmental, educational, social and cultural, tourism, business, family, journalistic, or transit purposes (Art. 95 (2), Government Regulation No. 31 of 2013 on Implementation Regulation of Law No. 6 of 2011 on Immigration) (“Government Regulation”).
For further discussion on Immigration Law and the Government Regulation on Immigration see ILD No. 203 and ILD No. 307.
The main purpose of the 2013 Regulation is to exclude Iran from the list of nationalities that are eligible to apply for a Visa on Arrival (Art. 1, 2013 Regulation).
Foreign nationals that are not eligible for a Visa on Arrival must apply to the Minister or Indonesian representative in their home country for a Temporary Stay Visa before entering Indonesia (Art. 90, Government Regulation).
Only foreign nationals of the following countries can apply for a Visa on Arrival (Appendix to the Fifth Amendment):
