The Minister of Public Works has issued Regulation No.28/PRT/M/2006 on 28 November 2006 and came into immediate force. The underlying premise of the Regulation is to ensure not only that there is the requisite management, supervision, and control but that the benefits that can be derived from foreign construction services companies are maximized for the benefit of the national construction services sector.
Simply, the Regulation requires that all representative offices of foreign construction services companies (BUJKA / Badan Usaha Jasa Konstruksi Asing) must be licensed. To obtain a license will not be onerous but nevertheless the processes and procedures are comprehensive in nature. The license cannot be issued until all of the requisite conditions are satisfied. These conditions include evidence of equivalent competencies, classifications, qualifications each of which is required to be certified.
