ESDM Regulation on Ground Water Conservation

Minister of Energy and Mineral Resources has issued Regulation No. 15 of 2012 on Ground Water Conservation (“ESDM Regulation”) to create a regulatory framework necessary to conserve ground water quality. It is an implementation of Law No. 7 of 2004 on Water Resources (“2004 Water Resources Law”).

The ESDM Regulation applies to any parties that utilize ground water (Art. 3), particularly institutions that use Government buildings, state-owned and regional owned companies (“BUMN” and “BUMD”) buildings, and state-owned legal entity (“BHMN”) buildings. In addition, the ESDM Regulation also applies to Ground Water Utilization Permit Holders and Ground Water Business Permit Holders (Art. 5).
