In 2021, Indonesia’s Investment Coordinating Board (Badan Koordinasi Penanaman Modal – “BKPM”) introduced Regulation No. 4 of 2021 on Guidelines and Procedures for Risk-Based Business Licensing (Perizinan Berusaha Berbasis Risiko – “PBBR”) Services and Investment Facilities (“Regulation 4/2021”).[1] Since then, this framework has been serving as one of the implementing frameworks to Regulation of the Government No. 5 of 2021 (“Regulation 5/2021”), which details a wide array of services relating to Business Licenses (Perizinan Berusaha – “PB”) and investment facilities.[2]
