Minister of Finance Issues Updated List of Goods Prohibited from Being Exported

  • Following the issuance of Regulation of the Minister of Trade No. 20 of 2024 (“Second Amendment”) on the Second Amendment to Regulation of the Minister of Trade No. 22 of 2023 on Goods Prohibited from Being Exported (“Regulation 22/2023”), the Minister of Finance (“Minister”) has decided to introduce an updated list of goods prohibited from being exported based on the Second Amendment through the issuance of Decree No. 46/KM.4/2024 (“Decree 46/2024”), which has been in force since 11 October 2024. Consequently, the previous framework that outlined the above list of export-prohibited goods, i.e. Decree of the Minister No. 19/KM.4/2024 (“Decree 19/2024”), has now been repealed and replaced.
  • In essence, Decree 46/2024 stipulates various goods that are prohibited from being exported, as comprehensively listed under the Appendix to Decree 46/2024. This list comprises 486 items that are identified by their Harmonized System (“HS”) Codes, including: 1) Whole wood under HS Code 1401.20.10; 2) Wood with diameters that do not exceed 12 mm under HS Code 1401.20.21; 3) Other types of wood under HS Code 1401.20.29; 4) Split bark wood under HS Code 1401.20.30; 5) Wood in the form of baulk, sawlog and veneer logs under HS Code 4403.11.10; and so forth.
  • It should also be noted that the goods that are prohibited from being exported encompass removals of goods from: 1) Free-trade zones and free ports; 2) Bonded storage areas; and 3) Special economic zones to locations that lie outside of official customs territory.
