- In 2021, the Director-General of Customs and Excise (“Director-General”) established a framework for entries and releases of goods to and from areas stipulated as free trade areas and free ports (Kawasan Perdagangan Bebas dan Pelabuhan Bebas – “KPBPB”) through the issuance of Regulation No. PER-22/BC/2021 (“Regulation 22/2021”). However, the Director-General has now decided to revise certain provisions originally set out under Regulation 22/2021 through the issuance of Regulation No. PER-10/BC/2024 on the Amendment to Regulation 22/2021 (“Amendment”), which has been in force since 24 October 2024.
- Pursuant to the Amendment, any goods that derive from other KPBPB, special economic zones (Kawasan Ekonomi Khusus/KEK) and bonded storage areas (Tempat Penimbunan Berikat/TPB) and that are imported after the submission of customs notifications can secure goods release approval letters (Surat Persetujuan Pengeluaran Barang – “SPPB”). By way of comparison, the aforementioned securing of SPPB was not originally outlined under Regulation 22/2021.
- Moreover, the Amendment now states that customs notifications for imports of goods to and from locations outside customs areas will be subject to examinations that will assess the fulfillment of applicable restrictions and/or prohibitions. In the event that applicable restrictions and/or prohibitions outline a limit or threshold regarding the amount of goods that are permitted to enter or be released from KPBPB, then examinations of goods will be carried out electronically in accordance with the applicable framework on the electronic reduction of export and import quotas.
