- The government has adjusted the applicable non-tax state revenue (Penerimaan Negara Bukan Pajak – “PNBP”) applicable at the Ministry of Law and Human Rights (“Ministry”), as originally outlined under Regulation of the Government No. 28 of 2019 (“Regulation 28/2019”), through the issuance of Regulation No. 45 of 2024 (“Regulation 45/2024”), which is set to come into force on 18 December 2024. The enforcement of the new framework of Regulation 45/2024 will result in the repeal and replacement of Regulation 28/2019.
- While maintaining the majority of services provided by the Ministry that are subject to the imposition of PNBP, as originally outlined under Regulation 28/2019, the new framework of Regulation 45/2024 has now clarified that the listed education and training services refer to training for the drafters of Laws and Regulations. Moreover, in terms of intellectual property services, Regulation 45/2024 has now clarified that legal services subject to PNBP refer to curation services and intellectual property services for the registration of international brands (including fees for international banking/transactions).
- In terms of PNBP for the issuance of passports through immigration services, the new framework has now adjusted the applicable PNBP tariffs as follows: 1) Non-electronic regular passports: Rp. 350,000 (five-year validity) or Rp. 650,000 (10-year validity) per application; and 2) Electronic regular passports: Rp. 650,000 (five-year validity) or Rp. 950,000 (10-year validity) per application. The now-revoked Regulation 28/2019 did not previously differentiate between applicable tariffs based on the validity periods of passports.
