- Following the mandate set under Regulation of the National Agency of Drug and Food Control (Badan Pengawas Obat dan Makanan – "BPOM") No. 13 of 2023 on Categories of Food, the BPOM is currently preparing a Draft Decree ("Draft Decree") of the Head of BPOM on Changes to Food Categories ("Categories") and Changes to Plant- or Animal-Based Raw Materials ("Materials"). In this regard, the Appendices to the Draft Decree outline a total of 16 Categories and 336 types of Materials (with and without usage restrictions).
- While changes to the above-mentioned Materials are essentially self-explanatory, the Draft Decree states that changes to the originally stipulated Categories refer to the following types of changes: 1) Additional types of foods have been integrated into the available Categories; and 2) Changes to the descriptions, definitions and/or basic characteristics of foods have been made to the originally stipulated Categories.
- In terms of the above changes, the Draft Decree mandates that any processed food products for which distribution permits have already been secured or that were in the process of being secured prior to the enforcement of the Draft Decree will have to be brought into line with the new framework within 24 months of its enforcement.
- It should be noted that the Draft Decree is currently being deliberated and may thus be subject to further changes.
