- In 2021, the Coordinating Minister for Economic Affairs ("Coordinating Minister") issued Regulation No. 7 of 2021 on Changes to the List of Nationally Strategic Projects (Proyek Strategis Nasional – "PSN"), which was amended several times, most recently through the issuance of Regulation of the Coordinating Minister No. 8 of 2023 (collectively referred to as "Regulation 7/2021"). However, in an effort to accommodate current legal requirements and developments, the Coordinating Minister has now issued Regulation No. 6 of 2024 on the Fifth Amendment to Regulation 7/2021 ("Fifth Amendment"), which has been in force since 16 May 2024.
- Outlined comprehensively under the Appendix to the Fifth Amendment, this new framework has expanded the list of PSN that were originally outlined under Regulation 7/2021 from 204 projects to 218 projects that now fall under the PSN classification.
- In addition to the above-described expansion of the PSN list, the Fifth Amendment has also expanded the list of programs that fall under the PSN classification from 13 to 15 forms of programs. In this regard, the Fifth Amendment has now included the following programs: 1) Programs for the development of the tourism and aviation industries through improvements in aerial connectivity; and 2) Programs for toll road modernization via the application of a multi-lane, free-flow (MLFF) system.
