Ministry of Trade Postpones Export Ban on Five Mining Commodities until 1 January 2025

  • The Director-General of Foreign Trade at the Ministry of Trade ("Ministry"), Budi Santoso ("Director-General"), has stated that the relaxation of various policies and regulatory frameworks that address exports of five mining commodities (i.e. laterite iron concentrate, copper concentrate, zinc concentrate, lead concentrate and anode slime) is essential as a part of efforts to establish domestic refineries and/or processing industries that are capable of exporting value-added mining commodities. In this regard, the Director-General has affirmed that the Ministry is currently supporting the revision of export policies in order to accommodate the above policy relaxation.
  • While the enforcement of Regulation of the Minister of Trade ("Minister") No. 22 of 2023 on Goods That Are Prohibited from Being Exported ("Regulation 22/2023") meant that a ban on the export of the above-outlined mining commodities was set to be introduced by 1 June 2024, the Minister has now issued Regulation of the Minister No. 10 of 2024 on the Amendment to Regulation 22/2023, which has postponed the export ban until 1 January 2025.
  • In addition to the above-outlined revisions, the Director-General has also affirmed that the Minister has revised Regulation of the Minister No. 23 of 2023 on Export Policies and Arrangements ("Regulation 23/2023") through the issuance of Regulation of the Minister No. 11 of 2024 on the Amendment to Regulation 23/2023. Among various adjustments to this framework, the Director-General has clarified that exports of the above-listed five types of mining commodities may continue to be carried out until a new deadline of 31 December 2024. (ANT)
