Toll Roads Now Required to Be Equipped with MLFF Toll Fee Collection Systems

Following the latest amendment to Law No. 38 of 2004 on Roads through the issuance of Regulation of the Government in Lieu of Law No. 2 of 2022 on Job Creation, the government has now decided to update the framework on toll roads through the issuance of Regulation of the Government No. 23 of 2024 ("Regulation 23/2024"), which has been in force since 20 May 2024.
The enforcement of Regulation 23/2024 has resulted in the repeal and replacement of the previous framework on toll roads, as set out under Regulation of the Government No. 15 of 2005, which has been amended several times, most recently through the issuance of Regulation of the Government No. 17 of 2021 (collectively referred to as "Regulation 15/2005"). However, it should also be noted that the implementing frameworks to Regulation 15/2005 will remain in force, provided that the provisions contained therein do not contradict any of those outlined under Regulation 23/2024.
Among the various adjustments and provisions that have been introduced, Regulation 23/2024 now mandates that the collection of toll fees from toll-road users should be carried out electronically via non-stop, contactless technology commonly known as multi-lane, free flow systems ("MLFF"). Indonesia’s MLFF systems will be organized by the Minister of Public Works and Public Housing ("Minister") in cooperation with business entities that are assigned to manage and organize said systems.
When MLFF systems eventually come into operation along Indonesia’s toll roads, Regulation 23/2024 mandates that toll-road users should register their motorized vehicles through the forthcoming MLFF mobile application that will be approved by the Minister. In the event that MLFF systems are unable to detect which toll gates toll-road users enter through, then said users will be charged double the relevant toll for the furthest distance over the given section of toll road.
