- In response to Indonesia, along with many other areas of the world, facing an increasing risk of significant natural disasters due to the ongoing effects of climate change, the Executive Director of the Indonesian Centre for Environmental Law (ICEL), Raynaldo Sembiring ("Executive Director"), speaking at a recent event, issued a statement urging the Indonesian Government to introduce legislation aimed at mitigating the effects of climate change and to ensure that the country’s national regulatory frameworks are up to the task of dealing with the ever-growing the impacts of climate change. While the Executive Director has conceded that deliberations of the Draft Bill on Climate Change ("Draft Bill") were likely to be a lengthy process, the Executive Director nevertheless believes that the Draft Bill offers improved benefits for the general public, as Indonesia’s current regulatory frameworks in this area have yet to accommodate matters relating to climate change holistically.
- Also speaking at the event was Andri Gunawan Wibisana, a law professor and an expert on environmental law at the University of Indonesia. During his address, Professor Wibisana stated that the currently applicable framework of Regulation of the President No. 98 of 2021 ("Regulation 98/2021"), which sets out Indonesia’s efforts to achieve the country’s nationally determined contribution (NDC) toward limiting any increase in global average temperatures, was insufficient to tackle the various issues that are associated with global climate change, as this framework focuses solely on investments in certain development projects.
- In response to the demand to pass the Draft Bill, Benny Kabur Harman, a member of Commission III at the House of Representatives (Dewan Perwakilan Rakyat – "DPR"), has affirmed that the Draft Bill has been listed under the 2019 - 2024 National Legislation Program. It should also be noted that while the DPR is continuing to solicit input from relevant stakeholders and the general public regarding the Draft Bill, it has unfortunately yet to receive the draft and academic script of the Draft Bill.
