Submissions of Documents for Cassation and Judicial Reviews Required to Be Performed Electronically from 1 May 2024

  • As a follow-up to Regulation of the Supreme Court No. 6 of 2022 on the Electronic Administration of Submissions of Legal Efforts, Cassation Trials and Judicial Reviews at the Supreme Court, as well as Decree of the Head of the Supreme Court No. 207/KMA/SK.HK2/X/2023 dated 12 October 2023 on Technical Guidelines for the Electronic Administration of Submissions of Legal Efforts, Cassation Trials and Judicial Reviews at the Supreme Court, certain matters have now become applicable, as specifically introduced through the issuance of Letter of the Clerk of the Supreme Court No. 712/PAN/HK1.2.3/IV/2024 on the Electronic Enforcement of Legal Efforts, Cassation Trials and Judicial Reviews, which has been in force since 23 April 2024.
  • Six specific matters are stipulated under the Letter, including the following: 1) In terms of any deeds of cassation and judicial review applications that are dated 1 May 2024 onwards, said bundles (berkas) of applications should be delivered electronically, meaning that printed applications are no longer required to be delivered to the Supreme Court; 2) Deliveries of bundles should be sent through version 5.5.0 of the Court Case Information System (Sistem Informasi Perkara Pengadilan/SIPP) application; 3) The administrative processing of cassation and judicial reviews at the first level can still be implemented manually/directly until the e-court application for cassation/judicial reviews becomes available.
  • It should also be noted that any applications for the above-described legal efforts that were submitted prior to 1 May 2024 should be processed in line with the following provisions: 1) Bundle A and Bundle B should still be delivered to the Supreme Court; 2) Electronic documents should be delivered in accordance with Circular of the Supreme Court No. 1 of 2024; 3) Electronic documents should be sent through the Decision Directory application; and 4) The printing of barcodes on cover letters should be completed through the Decision Directory application
