Govt. Set to Further Revise Regulation of Minister of Trade No. 36 of 2023

The Minister of Trade ("Minister") issued a statement recently confirming that the rules that apply in relation to imports of the goods of migrant workers (Pekerja Migran Indonesia – "PMI") are no longer governed by the framework of Regulation of the Minister No. 36 of 2023 ("Regulation 36/2023") but will instead revert back to the previous framework of Regulation of the Minister No. 25 of 2022.
In this regard, goods of PMI that are imported into Indonesia have now been limited to a maximum value of US$ 1500 only. However, it is important to note that the limitations on Import-Duty Exemptions, Non-Levies of Value Added Tax (VAT), Sales Tax on Luxury Goods (STLGs) and Article-22 Income Tax also apply.
If the values of PMI goods exceed the US$ 1500 limit, then the excess value will be treated as regular delivery goods and will be subject to the imposition of an import duty of 7.5%.
In addition to addressing the issue of PMI goods, the government has also agreed to postpone the issuance of technical considerations for several commodities, given that Regulation 36/2023 is set for imminent revision.
The amendment to Regulation 36/2023 is set for further discussion and elaboration at a technical coordination meeting which will involve input from all relevant related ministries and government institutions. _(ANT)
