LKPP Introduces Updated Framework on the E-Catalog for Procurements of Government Goods and Services

  • In an effort to ensure that the organization of the electronic catalog ("E-Catalog"), as originally mandated under Decree of the Head of the National Public Procurement Agency (Lembaga Kebijakan Pengadaan Barang/Jasa Pemerintah – "LKPP") No. 122 of 2022 ("Decree 122/2022"), is in line with current requirements, LKPP has decided to revise various provisions that specifically address the E-Catalog through the issuance of Decree of the Head of LKPP No. 177 of 2024 ("Decree 177/2024"), which has been in force since 26 March 2024.
  • This new framework is comprehensively outlined under the Appendices to Decree 177/2024 and covers three main aspects that specifically relate to the organization of the E-Catalog, as follows: 1) Management of the E-Catalog; 2) Listing of products in the E-Catalog; and 3) E-purchasing through the E-Catalog. It should be noted that services for the selection of goods or service providers through the E-Catalog will continue to be subject to the imposition of non-tax state revenue (Penerimaan Negara Bukan Pajak/PNBP).
  • It should also be noted that Appendix II to Decree 177/2024 outlines the various requirements that have to be met by business actors who wish to list their products in the E-Catalog (e.g. business permits, taxation requirements, privacy policy and so forth), as well as various requirements that apply to listed products themselves (e.g. categories, prices and other information relating to listed products).
  • While any goods/services that are listed in the E-Catalog in compliance with Decree 122/2022 must ultimately be brought into line with the Decree 177/2024 version of the E-Catalog, said listed goods/services will remain available for transactions, provided that the products in question remain actively listed and the e-purchasing feature for said products remains active. However, any listing and e-purchasing that is undertaken through the E-Catalog must fully adhere to the provisions set out under Decree 177/2024 by 31 December 2024. Nevertheless, any order letters that have already been signed in accordance with Decree 122/2022 will remain valid up until their expiration dates.
