Govt. Prepares Draft Regulation on the Governance and Protection of Indonesian Migrant Workers

  • The Deputy for the Coordination of Digital Economy, Manpower and Micro-, Small- and Medium-Scale Enterprises at the Coordinating Ministry for Economic Affairs ("Coordinating Ministry"), Rudy Salahuddin ("Deputy"), has issued a statement asserting that the overseas job market is one option that is capable of absorbing Indonesia’s demographic spike through placements of Indonesian migrant workers (Pekerja Migran Indonesia – "PMI"). Said placements are expected to create up to three million jobs during the 2020 - 2024 period.
  • However, this PMI placement potential remains significantly compromised by various issues that range from a lack of required education and skills to instances of fraud during the recruitment process. In response to this state of affairs, the Deputy has affirmed that the Coordinating Ministry has been assigned by the president to review the governance of PMI placements with the ultimate goal of drawing up a Draft Regulation of the President on the Strengthening of Governance for the Placement and Protection of PMI ("Draft Regulation").
  • If ultimately enforced, the Deputy has affirmed that this new framework would aim to ensure that the rights of Indonesian citizens who apply to work overseas are fully protected, while said citizens should also be able to enjoy a proper working life. The Draft Regulation is set to cover several main aspects that relate to PMI, specifically: 1) PMI placements; 2) Protection of PMI; 3) Supervision of the implementation of PMI placements; 4) Executors of PMI placements; 5) Supporting agency for PMI placements; and 6) PMI records.
  • Given the importance of the above Draft Regulation, the Deputy has also stated that a public consultation or meaningful participation session will be organized in order to solicit input for the Draft Regulation from various stakeholders and the general public.
