Govt. Provides Six Main Remarks on the Currently Deliberated Draft KIA Bill

  • As deliberations of the Draft Bill on Mother and Child Welfare ("Draft KIA Bill") have now reached the end of their first period, which addressed the first 1000 days of a child’s life after conception ("1000 Day Phase"), the Minister for Women’s Empowerment and Child Protection, I Gusti Ayu Bintang Darmawati ("Minister"), has stated that the Draft KIA Bill represents a joint-commitment between the government and Indonesia’s House of Representatives (Dewan Perwakilan Rakyat – "DPR") that will hopefully ensure the welfare of mothers and children during the 1000 Day Phase.
  • In this regard, the Minister has affirmed that the government has put together six main remarks regarding the Draft KIA Bill, which break down as follows: 1) The title of the Draft KIA Bill has been adjusted to include the “1000 Day Phase” nomenclature; 2) The definition of “child” under the Draft KIA Bill only applies to the 1000 Day Phase period; 3) Maternity leave for working mothers should be initially granted for a three-month period and is extendable for a further three-month period under special conditions, as proven through a doctors’ statements; 4) Husbands are entitled to enjoy between two and three days of leave in order to accompany their wives during childbirth or miscarriages; 5) The Draft KIA Bill also covers matters relating to mothers with special conditions (e.g. single mothers, mothers who are victims of violence, mothers with HIV/AIDS, mothers with legal issues and so forth). 6) Husbands and/or other family members will be held responsible for and obliged to ensure the welfare of mothers and children.
