Implementing Guidelines Issued for PNBP Fines Due to Failure of Certain Types of Private PSE to Perform Access Terminations

The Minister of Communication and Information Technology has issued Decree No. 172 of 2024 on Implementing Guidelines for Non-Tax State Revenue (Penerimaan Negara Bukan Pajak/PNBP) Deriving from the Imposition of Administrative Fines for Violations of the Mandatory Requirement for User Generated Private Electronic System Organizers (Penyelenggara Sistem Elektronik – "PSE") to Perform Access Terminations (collectively referred to as "Implementing Guidelines"), which has been in force since 5 March 2024.
The Decree sets out various Implementing Guidelines, which encompass the following aspects: 1) Formula for administrative fines; 2) Procedures for the imposition of administrative fines; 3) Supervision of PSE compliance; 4) Scheme for and simulation of the imposition of administrative fines; and 5) Commitment letter format for the payment of administrative fines.
Details of each of the above-listed aspects are comprehensively set out under Appendices I – V to the Decree.
