Use of Remote Biometric Identification by Legal Enforcers Limited under New EU AI Act

  • Originally proposed back in 2021, the Artificial Intelligence ("AI") Act was finally passed by the European Union ("EU") on 13 March 2024. As officially reported through the official website of the European Parliament, this measure has been introduced in order to protect basic rights, democracy and legal supremacy from the high levels of risk that are associated with the ever-increasing use of AI, as well as to expand the space available for innovation.
  • Moreover, through the AI Act, the European Parliament is also aiming to ensure that humanity and European values become core principles of AI development. In this regard, certain matters are specifically regulated under the AI Act, including the following: 1) Prohibition on certain AI applications that threaten the rights of citizens; 2) The use of remote biometric identification by legal enforcers will be principally prohibited, except in certain situations that are specifically defined and detailed in the AI Act; 3) Certain obligations that must be met by AI systems categorized as high risk; 4) All general-purpose AI ("GPAI") systems and GPAI models must comply with certain transparency requirements; 5) Regulations and real-world testing frameworks must be stipulated at the national level. The AI Act will be fully enforced within 24 months of its official enforcement date.
