Indonesian Press Council Dismisses Concerns over Publishers' Rights Framework

  • The Head of the Commission for Complaints and the Enforcement of Press Ethics at Indonesia’s Press Council ("Council"), Yadi Hendriana ("Head"), has dismissed concerns relating to the newly introduced framework of Regulation of the President No. 32 of 2024 on the Responsibilities of Digital Platform Companies to Support Quality Journalism ("Regulation 32/2024"), which is being seen by some as only benefiting certain parties. In this regard, the Head believes that Regulation 32/2024 will ultimately benefit both large- and small-scale media companies, as said companies will have equivalent levels of bargaining content and have a greater opportunity to gain prominence through digital platform giants.
  • During the same statement, the Head also clarified that Regulation 32/2024 will not restrict the scope of journalistic products, as the new framework merely sets out the applicable mechanism for the distribution of content and the responsibilities of digital platforms. As the Council already has jurisdiction over the ethical dimensions of three main journalistic processes (i.e. coverage, editing and publishing), the Head has affirmed that Regulation 32/2024 will address the ethical distribution of content, an area which does not currently fall under the Council’s purview.
  • In an effort to oversee the implementation of Regulation 32/2024, the Head has also affirmed that the Council is currently establishing a task force to address this matter. The members of this task force will comprise senior journalists and other experts (e.g. information technology [IT], legal and business experts). In this regard, the Head has also given his assurance that the new task force will remain free from government intervention and will only be filled with professionals and experts who are drawn from the journalistic and media sectors.
  • In a similar fashion, the Director-General of Public Information and Communication at the Ministry of Communication and Information Technology, Usman Kansong ("Director-General"), assured the public in a recent statement that Regulation 32/2024 will be implemented based on the principle of, “equality before the law”, meaning that all digital platforms that distribute news, particularly those that commercialize their news distribution, will be subject to the enforcement of Regulation 32/2024.
