KPPU and Indonesian Attorney Generals Office Initiate Legal Enforcement Collaboration for Indonesian Business Competition Law

  • The Deputy Chairman of the Business Competition Supervisory Commission (Komisi Pengawas Persaingan Usaha "KPPU"), Aru Armando, has stated that the most disadvantaged party during any case of unfair business competition are consumers. This opinion was presented during an in-house training activity titled, “Mergers and Acquisition Practices Through the Perspective of Business Competition”, which was held in the Datun Meeting Room at the Indonesian Attorney General's Office in Jakarta on 27 February 2024. During his presentation, Mr. Armando stated that mergers and acquisitions were associated with a number of positive impacts, one of which is the creation of synergies and business collaborations that encourage growth and business diversification, including improved efficiency.
  • In Indonesia, business actors that undergo any mergers and acquisitions are legally required to notify the KPPU. In this regard, the KPPU is ultimately responsible for deciding whether to accept, reject or accept with certain conditions any such actions. Said KPPU decisions are seen as crucial and require thorough consideration in order to ensure that a given corporate action will not result in any unfair business competition within the country.
  • This event was held in line with an ongoing collaboration between the KPPU and the Indonesian Attorney General’s Office that aims to establish similar perspectives regarding the legal enforcement of business competition law within Indonesia.
