Requirements for the Issuance of Technical Considerations for Imports of Textile Commodities Introduced

  • In an effort to facilitate the availability of textiles and textile products as raw and/or auxiliary materials for use by industries, the Minister of Industry ("Minister") has introduced the applicable requirements and procedures for the issuance of technical considerations ("Considerations") for imports of textiles, textile products, bags and footwear (collectively referred to as "Commodities") through the issuance of Regulation No. 5 of 2024 ("Regulation 5/2024"), which is set to come into force on 10 March 2024.
  • Broadly speaking, Regulation 5/2024 states that any business actors may engage in the importation of various types of commodities, which are comprehensively listed under Appendix I to Regulation 5/2024, as raw materials, auxiliary materials and/or consumer goods after they have first secured import approvals ("Approvals") from the Minister of Trade. In this regard, Regulation 5/2024 has further classified the types of business actors into three categories ("Importers").
  • In order to secure said Approvals, Regulation 5/2024 requires Importers to first secure Considerations, along with any related amendments, from the Minister through the submission of applications via the Indonesia National Single Window system, which involves the filling out and uploading of various types of required data and/or documents depending on relevant Importer classification.
  • Following the issuance of Considerations, Importers are required to submit Approvals and any related amendments, along with various relevant reports (e.g. import realization, distribution realization and utilization reports). Furthermore, any Importers who fail to adhere to the issued Considerations will be subject to the imposition of various administrative sanctions.
