Road to a Quality Digital Press: Govt. Promulgates Regulation on Publishers Rights

President Joko Widodo has officially issued Regulation of the President No. 32 of 2024 on the Responsibilities of Digital Platform Companies to Support Quality Journalism ("Regulation 32/2024"), a new legal instrument that specifically regulates publishers’ rights. Regulation 32/2024 aims to regulate global digital platform companies (e.g. Google, Meta) so that they act with equality and fairness when posting new content from local and national media.
Regulation 32/2024 has been long awaited and has been subject to a lengthy deliberation process that has aimed to ensure that the concerns of the press are properly addressed through its various provisions. It should be highlighted that Regulation 32/2024 does not aim to limit press freedoms or moderate press content in any way. Instead, this new framework specifically addresses business relationships between press companies and digital platform companies.
The obligations that apply to digital platforms companies under Regulation 32/2024 include prioritizing press company content and fostering journalistic training programs. However, it should be noted that despite the various obligations that digital platform companies are now required to meet, no imposable sanctions are provided under this new framework.
