Forecasting the Course of ITE Law Implementing Regulations: the EUs Digital Markets Act and Digital Services Act

Overview

On 2 January 2024, Law No. 1 of 2024 on the Second Amendment to Law No. 11 of 2008 on Electronic Information and Transactions (“ITE Law”) came into force. This amendment has been long awaited by the general public due to the broad scope of its impact. Once promulgated, however, attention inevitably shifted towards the promulgation of its various implementing provisions. On 5 January 2024, the Director-General of Public Information and Communication at the Ministry of Communication and Information Technology (“Ministry”) stated that a total of three implementing regulations to the ITE Law were currently in the pipeline.
