Employees Working on Election Day Entitled to Receive Overtime Payments

  • The Minister of Manpower ("Minister") has issued  Circular No. 1 of 2024 ("Circular 1/2024") on the Implementation of Holidays for Workers/Laborers (collectively referred to as "Employees") on the Day and Date of Voting in the General Election and Elections of Governors, Regents and Mayors (collectively referred to as "Election"), which has been in force since 26 January 2024.
  • Election day has been stipulated as a national holiday so that Indonesia’s general public can fully exercise its voting rights. As a result, employers are required to provide opportunities for their Employees to vote.
  • If Employees are required to work on the day of the Election, then the relevant employers must arrange times during which their Employees can vote. Moreover, employers are also required to pay overtime wages to Employees and to comply with other Employee rights.
