Handling of Human Trafficking and Problematic Indonesian Migrant Workers Regulated

  • The Minister of Social Affairs has issued Regulation No. 8 of 2023 on the Handling of Victims of Human Trafficking and Problematic Indonesian Migrant Workers, which has been in force since 28 December 2023. The issuance of this new regulation aims to increase welfare, quality and life sustainability (kelangsungan hidup); restore social functions in order to achieve independence; and increase the social resilience of human trafficking victims and/or problematic Indonesian migrant workers ("Problematic PMI") during the handling of social-welfare problems.
  • The handling of human trafficking victims and Problematic PMI should be implemented based on the results of assessments that are conducted by social workers that suggest indications of exploitation, either domestically or abroad. Exploitation may take the following forms: 1) Prostitution; 2) Forced work or servitude (kerja atau pelayanan paksa); 3) Slavery; 4) Oppression; 5) Extortion; 6) Exposure to radicalism or terrorism; 7) Utilization of physical, sexual and reproduction organs, including sexual exploitation; and so forth.
  • Said victims will be handled through processes of social rehabilitation, social security, social empowerment and/or social protection. The handling stages break down as follows: 1) Facilitation of access; 2) Initial approaches and mutual agreement; 3) Comprehensive and sustainable assessments; 4) Social services planning; 5) Implementation; 6) Monitoring and evaluation; and/or 7) Post services and termination.
  • The social reintegration of the above-described victims should aim to reintegrate said persons into family/community environments while avoiding any stigmatization, providing a sense of security and ensuring access to resource systems. The various stages that are involved in this process include the physical, mental and psychosocial preparation of victims, family/community readiness, return to family, monitoring and termination. Any rejection by families/communities should result in the finding of replacement families in accordance with applicable laws and regulations.
